So what's all this about?

On May 26th 2011 a new EU directive came into effect that requires website owners to make changes to their sites with regard to how cookies are used to store visitor information. It becomes UK Law on May 26th 2012. It applies all to all websites using cookies and not just commercial ones.

This law called The EU Privacy Law is amended privacy legislation that requires websites to ensure their visitors are fully informed as to which cookies are stored and why they are used on a computer or any other web connected device.

The law is being regulated and overseen in the UK by The Information Commissioner's Office (ICO) and you can read their statement here. They have the power to prosecute non compliant firms and seek fines of up to £500,000

What is a cookie exactly?

 Cookies are small text files placed on your computer by a web browser. They are used by almost all websites, for a variety of purposes:

  • Analysis of visitor behaviour (known as 'analytics')
  • To personalise pages and remember visitor preferences.
  • To manage shopping carts in online stores
  • To track people across websites and deliver targeted advertising

How does this affect my site and how do I achieve compliance?

The ICO have classified four types of cookies.

Essential
Required for your website to function, for example to mark someone as being logged in or to manage their browsing session or to add products to a cart

Non-Essential but harmless
Not essential to core functionality but not used for tracking a user. Examples of this would be cookies that store user preferences such as font-size on a page.

Moderately intrusive
Used to track people but do not provide personally identifiable information, for example Google's Analytics

Very Intrusive
Used to track people and provide personally identifiable information for advertising and data collection purposes.

Sites produced by us use primarily a mixture of the first three types.

Should I really worry about this?

It's hard to say at the moment what stance the ICO will take in terms of prosecuting sites that don't comply with the new law.

We feel their primary attention will be focused on the sites using type four cookies 'very intrusive' without explaining their purpose to the user. However, it can't be ruled out and therefore we do recommend that site owners look to achieve compliance where possible.

Our solution

Our solution can be seen in action on this site. It produces a small pop-up at the bottom of the site when a user visits for the first time. This explains the new law and gives them the option to read the site's privacy policy which details how cookies work.

We feel that this should meet the requirements of the ICO and the new law based on the information we have been given so far.

For our existing web design clients, the solution above, can be installed for £45. This includes the code to produce the banner and a tailored privacy page detailing the cookies on your site along with your general privacy information.

What makes VTSDesign different from other web design companies?

Most of our sites are designed using a content management system.

How much does web site design cost?

Every website that we design is different.

The cost depends primarily on what features you require from the site and how much content you intend to place on it.

To give an idea, the average price for the sites in our portfolio falls in the range of £350 - £500.

An individualised quotation is provided for every enquiry with all aspects of the work detailed so you know exactly what you are paying for.

We include a year's web hosting free of charge with all new design projects.

We only ask for a 15% deposit if you are not using our hosting services.

If you will be hosting the site with us, then no deposit is required.

I want you to design my site, what happens now?

Once a design enquiry has been submitted to us, then one of our designers will contact you to arrange a consultation.

Usually, we come to meet you at your workplace or home but the meeting can be over the phone if preferred.

We will then go through all your requirements and explain how they could be presented on a web site.

After the consultation, we will produce a detailed quotation including a full timescale for the project.

Do you charge for updates?

Usually, there is no charge for minor updates such as minor cosmetic adjustments.

For major changes such as new features, or a change in the way the site looks, we will issue a fixed quotation based on our estimation of how long the work will take.

Most of our sites have a built in text editor allowing you to make changes in the same way as using a word processor. There are guides available on our site to show you how to do this.

You are also able to add and remove pages as you require.

Alternatively, we can make modifications and update content for you if you would prefer that (a small charge may be applicable depending on the volume of changes required).

If you require a major new feature or structure to your site in the future, then we are happy to provide a new quotation for your requirements

If you design my site, do I have to host it with you?

No, we are happy to work with your site at other hosting locations.

However, we prefer you to use our hosting services as this makes it far easier for us to design and maintain the site.

We offer the first year's hosting free of charge to all new design clients.

What sort of content should I have on my site?

This is entirely up to you but we are happy to offer guidance.

You can then add features for your visitors such as message board forums, E-Commerce, photo galleries and other interactive features.

Do you enter all the site content for me?

Yes, unless you want to enter it yourself. During our initial meeting with you, we establish how the content will be supplied, e.g. in a Word document (preferred)or handwritten notes etc.

If you are using our E-Commerce solution, then we can enter your products for you if required for an additional charge per product.

Can I have a login feature for all members on my site?

Yes.

This is a standard feature on all our sites.

You can limit access to individual features for each member as required.

You can also specify that new members to your site have to be approved before they can become registered members.

How long does it take for a site to be completed?

This depends entirely on the features that you have requested and how quickly the content is supplied.

As an example, a straightforward site can be done within a week if all content is provided before work begins.

At the start of the project, we will issue a timescale based on the quotation supplied.

Can I supply my own images and background graphics??

Yes of course

We will endeavour to fit them into the design of the site with your full input as to how you would like them to appear.

Will I be able to see my site as it develops?

Yes

We will give you a link where you can see every stage of your site's development. We think this is very important to ensuring we get the design exactly how you want it.

The site will only go live when you are completely happy with the final preview copy.

What screen resolution will you be designing my site for?

We target most of our sites at 1024 by 768 which is what the majority of people are browsing at currently.

However, the target resolution can be set to whatever suits your requirements.

Do I get to see all the code used on my site?

Yes

We adhere to open source policy. All code that we write is open for you to see and modify as required.

Once the project is complete and payment has been received, then the site and all code belongs to you with the exception of any licensed third party components used.

Will my website look the same to every visitor?

We test all our work on the following browsers

  • Internet Explorer 6,7 and 8
  • Firefox 2 + 3
  • Opera 9
  • Google Chrome 1 + 2
  • Safari

Obviously, there is a slight difference in appearance from browser to browser.

We endeavour to ensure however that these differences do not spoil the look of a site in any way.

When browser updates are released, we carry out testing of our sites to ensure that they continue to work in the way that they are supposed to.

Will my site appear on the first page of search engine listings?

We work with you to identify the key text relating to your site and the target audience that you want to appeal to.

We then build this text into each page of your site ensuring that the major search engines pick up on them

It is impossible to guarantee that you will get front page listing on a search engine without paying for a sponsored advert. However, with the right combination of keywords, your site will stand a good chance of featuring highly.

We can also discuss setting up sponsored ads so that you are guaranteed to get a front page listing if the right combination of search words are entered.

This is a sector where first impressions make a real difference, both for the potential student and for their parents.

Following several successful projects over many years , we have gained a real understanding with regard to what a school site needs to succeed.

Easy for different users to maintain..

This type of site is likely to have multiple users involved in updating from different areas of school life such as individual teaching departments.

Each user has their own account and all pages that are available for edit, feature the same easy to use text editor to allow for quick updates.

We use a comprehensive access rights system to ensure that administrators only get access to the areas of the site which they are responsible for editing. This means everyone can work together without conflicting each other's work.

This can be configured on a page, category or section basis for each user.

Keeping parents informed.

newsLatest school news from each department can be displayed automatically on a feed on the front page to ensure that everyone is up-to-date with current information.

School newsletters can be added to a download area and an email can be sent to parents whenever there is a new addition. This helps cut out the issue of important newsletters never making it home and if the parents choose to opt out of paper communications, can help reduce your paper usage.

A newsflash system can also be set up allowing urgent news to be sent by email or text to parents in the event of issues such as the school being closed due to adverse weather conditions.

Extensive use of imagery and video..

Imagery and videos play a very important part in a school website.

By using multiple images from as many different areas of school life as possible, we aim to create a true replication of what the school can offer. New galleries can be easily uploaded at any point whenever a new event occurs.

Using multimedia resources is also a good way to get students interested in contributing to the school website.

Videos can also be embedded into any part of our websites along with virtual tours of a school site.

Before using any student imagery on a site, we verify that the relevant permissions have been obtained for the media to be used.

Secure download area.

We can set up secure download area in the site. This is unique to each parent and allows them to obtain a username and password from the school, log-in and access their child's reports or other important correspondence relating to them.

This facility can be used for pupils to download coursework or training materials relevant to them from their teachers if required.

1. Our Intellectual Copyright:

We will hold intellectual copyright of any material, including any source code and original images created for the client until payment of the final invoice. At this time it will become the property of the client.

2. Clients Responsibilities with Regard to Copyright:

In situations where the client provides images, text and animations for their website they are legally responsible for ensuring that this material does not infringe any copyright. Certain images provided by us in the construction of the website may have been purchased under licence from stock image suppliers. These images are generally only licensed for use on a single website and may not be used in publicity material. The website owner is legally responsible for ensuring that this does not happen. If you wish to use any images from the site for other purposes please contact us for clarification.

3. Limitation of liability/indemnification:

Neither party will be liable to the other for special, indirect or consequential damages incurred or suffered by the other arising as a result of or related to the performance our work, whether in contract or otherwise, even if the other has been advised of the possibility of such loss or damages. Our total liability under these conditions with respect to the work, regardless of cause or theory of recovery, will not exceed the total amount of fees paid by the client to us.

4. Search Engine Promotion:

We are not by default responsible for the client’s on-going web site promotion. If the client requires the site to be promoted on an ongoing basis a separate contract must be agreed. The order in which websites are ranked in the search results is controlled by the search engines. We will endeavour to ensure that your site is successful in the search rankings through various methods. However, search engines frequently change their retrieval methods and we cannot be held responsible for future rankings unless otherwise agreed.

5. Cancellation:

Should the client wish to cancel a project at any point during the process they shall remain liable for the work that has taken place and shall be invoiced accordingly.

6 Quotations:

The price quoted to the client is for the work agreed on the quotation only. Should the client decide that changes are required after work on the website commences, then we will accept these changes with the provision that additional charges may have to be negotiated.

7. Advance Payment:

We ask for a minimum deposit of £100 or 10% of the project value if that is greater. We reserve the right to request a higher deposit in certain situations.

8. Payment terms:

Payment is currently accepted via credit or debit card at our online billing site. We also accept payment via bank transfer. If a site is hosted with us, then payment is due upon the site going ‘live’. If payment is not received by this point, then we reserve the right to suspend the site until payment is received in full. If the site is hosted externally, then payment is due in full before the code and site design can be released for upload to your hosting server.

9. Future work:

The website is provided to and accepted by the client as a fully functioning, completed work. By agreeing for the site to go ‘live’, the client is accepting that they are fully satisfied with the site. Any future structural or design changes to the site may require the issuing of a new quotation.

10. Compliance with Ecommerce, Accessibility or Other Regulations:

We design websites in accordance with the client’s specifications. It is the client’s responsibility to ensure that the website and its content comply with current regulations. We cannot accept responsibility for any failure to comply with regulations related to accessibility, selling online or regulations related to a specific business or trade. We recommend that where compliance related to any website or business is complex it may be necessary for the client to take legal advice from their solicitor

11. Hacking, defacing, viruses and spyware

Hacking, defacing, virus, database and spyware injection attempts are an unfortunately common part of internet life.  Whilst we build your site to be as secure as possible and we have a vast array of monitoring tools for sites hosted with us, we can accept no legal responsibility for any damages to reputation or monetary loss caused by illegal activity or the actions of others once it has been put live. If the site is hosted with us, then we will endeavour to fix the damage or restore from one of our nightly backups free of charge.  If you have chosen to host our design for you at your own choice of external hosting location, then any repair work will be chargeable and a quotation will be supplied.

12. Web Hosting

These terms of business apply to domain registration and hosting packages.

"We" & "Us" includes: VTSDesign of 3 Wood Street, Hoylake, Wirral, Cheshire, United Kingdom or any party acting on VTSDesign’s implicit instructions.

"You" includes the person purchasing the Services or any party acting on the customer's instructions.

"The Registrant" includes the person applying for a domain name or any party acting on the Registrant's instructions.

"The Registry" the relevant domain names Registry.

"Server" means the computer server equipment operated by us in connection with the provision of the Services.

"Web Site" means the area on the Server allocated by us to you for use by you as a site on the Internet.

The relationship entered into between you and us is governed by these following terms, which shall apply during, and where necessary after, the period of the commercial relationship between you and us.

If you choose to host your Web Site on our Servers, this indicates full agreement of the terms below.

1. Domain Name Registration

1.1. We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.

1.2. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant Registry; you shall ensure that you are aware of those terms and conditions and that you comply with them.

1.2.1. By registering a .uk domain name, you enter into a contract of registration with Nominet UK on the terms and conditions published at http://www.nominet.org.uk/.

1.3. You shall have no right to bring any claim against us in respect of any refusal to register a domain name by the relevant registration authority.

1.4. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the Registry to register your desired name.

1.5. We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant Registry but will not be obliged to take part in any such dispute.

1.6. We shall not release any domain to another provider unless full payment for that domain has been received by us.

2. Web Site Hosting And Email

2.1. We make no representation and give no warranty as to the accuracy or quality of information received by any person via the Server and we shall have no liability for any loss or damage to any data stored on the Server.

2.2. You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes and to promptly inform us if this clause or any sub clause of this clause has been breached or you become aware that they may have been breached. In particular, you represent, warrant and undertake to us.

2.2.1. you will not use the Server in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorise or permit any other person to do so.

2.2.2. you will not upload, post, link to or transmit:

2.2.2.1. any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way. 2.2.2.2. any material containing a virus or other hostile computer program.

2.2.2.3. any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.

2.2.2.4. any material which is forbidden by our acceptable use policy which is published here 2.2.3. you will not send bulk email whether opt-in or otherwise from our network. Nor will you promote a site hosted on our network using bulk email.

2.2.4. you will not employ programs which consume excessive system resources, including but not limited to processor cycles and memory.

2.2.5. any file you store on the Server will be reachable via a hyperlink from a page on your site.

2.3. We reserve the right to remove any material which we deem inappropriate from your Web Site without notice to you.

2.4. You shall keep secure any identification, password and other confidential information relating to your account and shall notify us immediately of any known or suspected unauthorised use of your account or breach of security, including but not limited to loss, theft or unauthorised disclosure of your password or other security information.

2.5. You shall observe the procedures which we may from time to time prescribe and shall make no use of the Server which is detrimental to our other customers.

2.6. You shall procure that all mail is sent in accordance with applicable legislation (including data protection legislation) and in a secure manner.

2.7. In the case of an individual User, you warrant that you are at least 18 years of age and if the User is a company, you warrant that the Services will not be used by anyone under the age of 18 years.

2.8. While we will use every reasonable endeavour to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorised users or hackers and we shall be under no liability for non-receipt or mis-routing of email or for any other failure of email.

2.9. No more than one log-in session under any one account may be used at any time by you. If you have multiple accounts, you are limited to one login session per system account at any time.

3. Service Availability

3.1. We shall use our reasonable endeavours to make available to you at all times the Server and the Services but we shall not, in any event, be liable for interruptions of Service or down-time of the Server.

4. Payment

4.1. All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site, errors and omissions excepted and shall be due and payable in advance of provision of the Services.

4.2. We reserve the right to change pricing at any time although all pricing is guaranteed for the period of pre payment.

4.3. Payment is due each anniversary month, quarter or year following the date the Services were established until closure notice is given in accordance with 5.4. If you choose to pay by credit or debit card you authorise VTSDesign to debit your account renewal fees from your card.

4.4. All payments must be in UK Pounds Sterling.

4.5. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £25.

4.6. Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled but not obliged forthwith to suspend the provision of Services to you.

5. Termination And Refunds

5.1. We shall be entitled to suspend the Services and/or terminate this Agreement forthwith without notice to you If you:

5.1.1. fail to pay any sums due to us as they fall due.

5.1.2. break any of these terms and conditions. 5.1.3. are a company and you go into liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors.

5.2. No refunds will be made under any circumstances for Services suspended in accordance with

5.1. 5.3. We reserve the right to suspend the Services and/or terminate this Agreement at any time. In the event of this You will be entitled to a pro rata refund based upon the remaining period of prepayment.

5.4. You may cancel the Services at any time. To do so you must request cancellation of the Services in writing including your account username and password. We will cancel the Services within 2 working days of receipt of your request.

5.5. During the first 7 days of Services, You are entitled to a refund of the basic hosting plan rental fee should You decide to cancel the Services. No full refunds or pro rata refunds will be made after the first 7 days of service should You decide to cancel the Services.

5.5.1. Domain name registration fees, charges for additional data transfer and charges for optional extras added to your account are not refundable under any circumstances.

5.5.2. You will not be entitled to a refund on this basis if you have previously held an account with VTSDesign.

5.6. Where payment has been made by credit or debit card, any refund will only be issued to the same credit or debit card.

5.7. On termination of this Agreement or suspension of the Services we shall be entitled immediately to stop access to your Web Site and to remove all data located on the Server.

6. Indemnity

6.1. You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to You and your use of the Services and the Server including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of any of the terms of this Agreement.

7. Limitation Of Liability

7.1. All conditions, terms, representations and warranties relating to the Services supplied under this Agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded to o the extent applicable under UK law, subject always to sub clause

7.2. Nothing in these terms and conditions shall exclude our liability for death or personal injury resulting from our negligence.

7.3. Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by you in respect of the Services which are the subject of any such claim.

7.4. In any event no claim shall be brought unless you have notified us of the claim within one month of it arising.

7.5. In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.

8. Notices

8.1. Any notice to be given by either party to the other may be sent by either email, fax or recorded delivery to the address of the other party as appearing in this Agreement or ancillary application forms or such other address as such party may from time to time have communicated to the other in writing, and if sent by email shall unless the contrary is proved be deemed to be received on the day it was sent or if sent by fax shall be deemed to be served on receipt of an error-free transmission report, or if sent by recorded delivery shall be deemed to be served two days following the date of posting.

9. Non-Waiver

9.1 Any forbearance or failure by us to enforce a contractual provision to which you are subject shall not affect our right to require such performance at any subsequent time, nor shall the waiver or forbearance by us of any breach of any provisions of the agreement herein be taken to be or held to be a waiver of the provision or provisions itself of themselves.

10. Law

10.1. This Agreement shall be governed by and construed in accordance with English law and you hereby submit to the exclusive jurisdiction of the English courts.

11. Headings

11.1. Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this Agreement.

12. Entire Agreement

12.1. These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you confirm that you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.

Our acceptable use policy ("AUP") is actively and strictly enforced. Offending content or users are removed from our servers, usually as soon as they are discovered, although we will always inform you when and why action has been taken.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality

In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material

Undesirable Content

Certain types of content are not permitted on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.

Bulk Email

The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Misuse Of Resources

Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and may be limited. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.
